A driver who was seriously injured when he left his car to go help a female who had crashed has won the right to make a compensation claim.

David Tolly was travelling along the M53 motorway when he stopped to help a lady who had crashed her car into the central reservation. He was then hit by two cars that did not see him. Mr Tolly suffered a broken spine and fractured ribs. He is now a paraplegic and paralysed from the chest down.
Initially the 46 year old was considered partly to blame by his insurance company for his injuries but a judge ruled that his actions were brave and commendable. Mr Tolly, from Birkenhead, is to receive a large accident claims compensation payout, the figure of which is yet to be decided upon.
