Accident At Work Case Summary
Mr Y was an employee of a national supermarket and responsible for replenishing groceries. Mr Y was in the freezer room and noticed that a number of wheeled cages had been positioned in front of the discontinued items. As Mr Y was moving these out of the way, a number of the frozen items from the cage fell off and onto Mr Y. One of these items was a large frozen turkey which struck Mr Y on the right shoulder. Mr Y suffered with badly torn ligaments in his shoulder as a result of this accident.

Liability was agreed on 90/10 split in Mr Y’s favour Mr Y received damages of £7664.
