Can I make an accident claim?

Yes, if you've had an accident in the last three years that wasn't your fault. This could be a road traffic accident where you were the driver, a passenger, a pedestrian, a cyclist or a motorcyclist. Or you may have had a slip, trip or fall when you were out and about. Or you might have had an accident at work. In all these situations, you can make an accident claim. The three year timescale runs once an individual has reached the age of 18 years old. Someone under 18 years old who has an accident still has until they are 21 to make a claim no matter when the accident happened.

How long does an accident claim take?

It depends on the circumstances of your accident claim. A simple claim can be settled in just a few months. A more serious injury will take longer. Our team will advise you. If you've suffered a very serious injury, for example, it will be in your best interests that we take enough time to assess the extent of your medical problems and the care you may need in the future. Whatever your situation, we'll put your interests – now and in the long term – first.

How much do I have to do?

We'll handle all aspects of your accident claim so you don't have to. We'll take care of the paperwork and keep you updated on progress all along the way. Which documents do I need to make an injury claim?

All you need to do is tell us the details about your accident. You can leave the paperwork to us. We'll arrange for any medical reports that might be required. We'll ask you if we need anything.

How is my case decided?

We write to the insurer of the guilty party first and they will investigate your claim and decide whether they accept responsibility for your injury. If they do they you will normally receive compensation. If they do not accept responsibility then we will investigate and consider whether you should go to court to force the party at fault to pay compensation.

Is the law different in Scotland?

Case Study

Mr C was injured in a Road Traffic Accident that occurred in May 2008. The Defendant was driving a lorry which was leaking oil over the road and caused Mr C to skid and fall off his bicycle. Mr C sustained a serious dislocation injury to his shoulder requiring steroid injections and eventually surgery. Due to his specialized physical job, Mr C was unable to work for three years following the accident.

Total damages received were £65,000 including £10,000 for his injury and the remainder including compensation for his loss of earnings, loss of pension, property damage, loss of shares and medical costs associated with his injury.
