Miner's Knee Compensation

Miner’s knee is a work-related injury that is caused by the repetitive action of kneeling. Over a long period of time, consistent kneeling causes damage to the inside of the knee, in particular the menisci cartilage. This in itself can cause osteoarthritis from pressure being applied to the joint.

Employer Responsibilities

Employers are duty-bound by law to look after the safety and welfare of their employees. By not supplying the correct safety equipment to help stop the development of miner’s knee, an employer could be liable to pay compensation. This safety equipment includes the provision of knee pads or kneeling boards to help decrease the pressure placed on the knees. Employers must also provide the correct training and minimise risks, amongst other rules laid down by the Health and Safety Executive (the official government body which regulates safety in the workplace).

Claiming Compensation for Miner’s Knee

There are many factors that could contribute to the development of miner’s knee. The symptoms of miner’s knee include:

  • Swelling
  • Sharp pains
  • Inflammation
  • Locking and stiffness in the knees

If you notice any of these symptoms you should go to your GP who can assess you and provide a diagnosis as well as recommend treatment.  Miner’s knee can cause long-term damage and even disability in certain cases, which can restrict the activities and job roles that people can take part in. Relatives could potentially need to look after the affected person if the injury is serious enough and it may mean they have to find employment in a job unrelated to the one they are trained for.

Amount of Compensation

Compensation is decided upon by assessing the severity of the injury and the impact that this injury has had upon you and your life. Firstly, compensation will take into account the pain, suffering and loss of function/amenity that has been caused by this injury. For example, if you can no longer complete certain tasks due to your injury then this may be covered through compensation. Similarly, if you have suffered financial losses due to your injury then this may be covered through compensation. This could include compensation to cover a loss of earnings that has occurred, such as a loss of income due to being unable to return to work. You should retain any receipts which highlight costs relating to your injury, such as treatment or travel costs. As compensation amounts are so individual, the best way to understand how much compensation you are likely to be owed based upon your injuries is to discuss your case with a personal injury solicitor directly.
