Non Malignant Pleural Disease Claims

Non-malignant pleural disease affects the lining of the lungs that is often caused by asbestos exposure. However, unlike asbestosis it is not a cancerous disease.

There are many cases of non-malignant pleural diseases that occur each year and a large majority of these cases concern people who have been exposed to asbestos at some point in their working lives.

Effects of Non-Malignant Pleural Disease

There are many different ways in which you can be affected by this disease. A common way in which non-malignant pleural disease impacts people is through pleural plaques. Pleural plaques refer to areas of the lungs that have thickened. There are usually no symptoms for pleural plaques. Instead, these plaques can be found during chest X-rays when looking for evidence of other health problems.

The ability to diffuse pleural thickening is not restricted to one area as pleural plaques can generally grow over the entire lung. This reduced lung capacity can result in breathlessness and chest pains in certain patients.

In most instances pleural plaque does not cause any symptoms. You can only claim for pleural plaque if:

  • There has been an exposure to asbestos
  • There is some evidence of physical symptoms.

Unfortunately you cannot claim compensation for any anxiety or other psychological symptoms as a result of being diagnosed with pleural plaque unless there are also physical symptoms.

Asbestos in the Workplace

Many different types of workers can be affected by asbestos exposure. Occupations like shipyard worker, carpenter, demolitionist or construction worker are more likely to come into contact with asbestos exposure for example.

Other asbestos-related illnesses include mesothelioma and asbestosis, both of which can be extremely debilitating and can result in employees having to give up their jobs to be cared for.

All employers no matter the industry have a duty of care to protect you from all hazardous substances in the workplace including asbestos. If it can be proven that the company, you worked for did not carry out the necessary and legal health and safety requirements then you may be able to make a workplace injury claim.

How Much Compensation?

All personal injury cases are unique and so the amount of compensation that is awarded in each case is also unique. Compensation is understood by looking at two specific factors: general damages and special damages.

General Damages

The pain and suffering that your injuries have caused are main factors that are used to determine how much general damage compensation you are owed. This will usually be determined by undergoing a medical examination, from which a report is created that highlights the length of time the injuries will take to heal as well as their severity. Our compensation calculator will give you an indication of how much general damage compensation you might be entitled to based upon your injuries.

Special Damages

In addition to receiving compensation for your injuries, you may be able to reclaim any financial losses that you might have suffered as a result of your injuries. Compensation for financial losses is known as special damages compensation. This can include losses such as loss of earnings due to not being able to return to work, the cost of treatment as well as travel to treatment. It is important that you keep any receipts or evidence of additional losses in order for these to be reclaimed. With the exception of children, there is a three-year time limit on making a personal injury claim. This time limit begins from the date that the accident initially occurred. Therefore, you should contact a personal injury solicitor as soon as possible to assess your case.
