The Impact of Carbon Monoxide

Carbon monoxide claims predominantly originate from exposure in the workplace. However, there are also instances where you can be exposed to the deadly gas in the home.

Your employer has a duty of care to protect you from the risk of being exposed to harmful substances under Health and Safety legislation. In particular, there are rules relating to the Control of Substances Hazardous to Health (CoSHH) which attempt to keep employees safe from certain scenarios like carbon monoxide exposure. For example, your employer will have to provide proper ventilation for workers who may have come into contact with carbon monoxide. 

Employers also have to ensure that risk assessments are carried out routinely as well as providing personal protective equipment such as masks where necessary. There are many other steps that employers should take to ensure safety. If your employer has not managed to fulfil or abide by any of the regulations pertaining to health and safety, then you may be able to make a claim if this negligence has resulted in you suffering an injury. 

If the exposure has happened outside of work, such as in a hotel, then your claim is just as valid. If you use facilities or public places, the operators of those areas also have a duty of care to ensure your safety while you are on the premises.

Compensation amounts are decided upon by assessing the amount of pain and suffering that an injury has caused you, which is usually understood through assessing your individual circumstances and receiving a medical examination. Compensation also takes into account a loss of amenity/loss of ability to function.
