CIRCUMSTANCES 

In September 2019 the client was instructed to repair a faulty shutter on a shop. They were told to remove the shutter promptly, without any lifting equipment, as the shop couldn’t trade whilst the shutter was broken.

The client climbed up some ladders and fully extended an arm to reach a hatch that contained a barrel. The barrel needed to be removed as it was attached to the ceiling and contained the motor which was causing the shutter to be faulty. Upon bearing the full weight of the barrel the client felt a sharp pain in their arm and subsequently sustained an injury to their bicep muscle.

The client had received no training in manual handling or lifting. The correct equipment that was necessary to carry out the work safely was not provided. 


INJURIES 

The client suffered a complete rupture of a bicep muscle which has left the client with weakness in an arm and limited lifting ability. The accident has resulted in the client suffering a permanent injury with ongoing symptoms.

The injury caused the client to have 6 weeks off work. It has also affected their ability to carry out work as due to the ruptured bicep the client can now only do light duties and can no longer do any overtime as this requires heavy lifting.


SETTLEMENT
