MRSA (sometimes referred to as a Hospital Acquired Illness or a Superbug) stands for methicillin-resistant Staphylococcus aureus. It is an infection resistant to most kinds of antibiotic. Staphylococcus can live on our bodies harmlessly but if it gets inside it can cause skin infections.

If you or a family member has suffered from an MRSA infection, you could be able to make a medical negligence compensation claim if a third party was at fault.

Who Can Get MRSA?

Strains of MRSA can be carried by healthy people but they are usually acquired by elderly people, hospital patients with open wounds or people who have had a long stay in hospital. MRSA can spread to people outside of the hospital environment too but these cases are more unusual.

Because the infection can spread easily, all medical staff should maintain a high level of hygiene while looking after patients. Always washing hands and regularly cleaning and changing bedding, towels and clothes, keeps the infection at bay.

The effects of the condition vary. Some patients may experience skin abscesses with fever and warmth around the infected area. However, others may have severe headaches, fatigue, muscle aches, shortness of breath and chest pains. In extreme cases, it is possible to develop pneumonia.

Can I Make A Claim For MRSA?

You may be able to make an MRSA compensation claim if you can prove that:

  • there was a delay in recognising your condition
  • there has been negligence in the care given for your infection
  • you have been given a wrong diagnosis for MRSA
  • or if there has been poor hygiene.

Like all other clinical negligence cases, it is possible to pursue a claim if you have suffered MRSA through no fault of your own and third-party blame can be established. Most medical staff are diligent and careful when dealing with patients. However, there are some instances in which the correct procedures have not been carried out or someone has acted carelessly.

It may be that you have suffered minor side effects or it may be that the MRSA has caused you to have time off work, leading to a loss of earnings.

First Personal Injury may be able to help you with your MRSA compensation case. It’s likely that you’ll have many questions about the personal injury claims process. Our team will aim to answer your questions and give you an idea of the validity of your MRSA claim.
